2 - Scope and acceptance
2.1 These General Terms and Conditions of Sale (the "Terms") apply to all sales of products made through the Website by the Seller to any individual buying for purposes outside their trade or profession (the "Customer").
2.2 The Customer must read these Terms before placing an order. By confirming the order, the Customer acknowledges having read them and accepts them in full.
2.3 The Seller may modify these Terms at any time. The version applicable to an order is the one in force on the date the order is placed.
2.4 The Customer must be at least 18 years old or have the authorisation of a legal guardian.
3 - Products
3.1 The products offered are artisanal accessories, as described on the Website. The Seller presents the main features of each product (materials, dimensions, colours, care instructions) as accurately as possible.
3.2 Photographs are as close as possible to the actual products, but slight variations in size, colour or appearance may occur due to screen settings or the artisanal nature of the products.
3.3 The products are produced in limited series. Offers are valid while stocks last. If a product becomes unavailable after an order, the Seller will inform the Customer as soon as possible and refund any amount already paid within 14 days.
4 - Prices
4.1 Prices are shown in euros (€), VAT not applicable, art. 293 B of the French General Tax Code, excluding delivery costs, which are shown separately before the order is validated.
4.2 The Seller may change its prices at any time. Products are invoiced at the price displayed at the time the order is placed.
4.3 For deliveries outside the European Union, the Customer may be liable for customs duties, import taxes or fees, which are not included in the price and remain the Customer's responsibility.
5 - Ordering process
5.1 By sending an email to alice.watel@gmail.com detailing the order, the Customer validates the purchase; this constitutes an irrevocable commitment that may only be challenged under the specific circumstances outlined in these General Terms and Conditions. The Customer will receive an email confirming the order, which will include all details of the contract (products ordered, price, shipping costs, etc.). It is recommended to keep this acknowledgment, as it serves as proof of the order.
5.2 The Seller may refuse or cancel an order where there is a legitimate reason, in particular a payment problem, an obvious pricing error, unavailability of the product, or an existing dispute with the Customer.
5.3 Information provided when placing an order must be accurate, complete, and up-to-date; the Seller shall not be held liable for any inability to deliver the Product, or for delivery errors or delays, resulting from incorrect Customer contact details.
6 - Payment
6.1 Payment of the full price is due upon order confirmation. The Customer pays for their order by bank card via the payment link sent by email following order confirmation.
6.2 The order is only processed once payment has been received. In the event of non-payment or payment refusal, the order is automatically cancelled.
7 - Delivery
7.1 Delivery areas: worldwide.
7.2 Delivery times will be indicated upon receipt of the order confirmation email sent by the Seller and apply from the time payment is confirmed. Delivery times are indicative.
7.3 Transfer of risk: the Customer bears the risk of loss or damage from the moment they (or a person they designate) physically take possession of the goods.
7.4 Damage in transit: the Customer must check the parcel on receipt and, if there is visible damage, state reservations on the carrier's delivery note and/or refuse the parcel, then notify the Seller within 3 working days at alice.watel@gmail.com with photographs.
7.5 If a parcel is returned to the Seller because the address was incorrect or the parcel was not collected, the Customer will bear the costs of re-shipping.
8 - Right of withdrawal
8.1 Period. In accordance with the French Consumer Code, the Customer has 14 days from the day they (or a third party they designate, other than the carrier) receive the goods to withdraw from the contract without giving any reason. For an order of several products delivered separately, the period starts at receipt of the last product.
8.2 How to withdraw. The Customer must notify the Seller of their decision by an unambiguous statement (email to alice.watel@gmail.com).
8.3 Return of goods. The Customer must return the goods no later than 14 days after notifying their withdrawal. Return shipping costs are borne by the Customer. Goods must be returned in their original condition, unworn and complete, with their packaging. The Customer is liable for any loss in value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
8.4 Refund. The Seller refunds all sums paid, including standard delivery costs, within 14 days of being informed of the withdrawal, using the same payment method as the original transaction. The Seller may withhold the refund until the goods have been received back.
8.5 Exceptions. In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalised.
9 - Legal guarantees
The Seller remains liable for the legal guarantees below, regardless of any commercial guarantee.
9.1 Legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code). The Customer benefits from a two-year guarantee from delivery of the goods. The Customer may choose between repair and replacement, subject to cost; if neither is possible, they may obtain a price reduction or cancel the contract and be refunded.
9.2 Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). The Customer may choose between cancelling the sale or keeping the item and obtaining a partial refund. The action must be brought within two years of discovering the defect.
9.3 Procedure. To use a guarantee, the Customer should contact the Seller at alice.watel@gmail.com with their order number, a description of the problem and photographs. The Seller will tell them how to return the product. Costs of returning a non-conforming product are borne by the Seller.
9.4 Normal wear and tear, damage caused by misuse, accident, or failure to follow care instructions are not covered.
10 - Liability
10.1 The Seller is liable under the conditions provided by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory consumer law.
10.2 The Seller is not liable for non-performance caused by force majeure as defined by Article 1218 of the French Civil Code, or by the Customer's own fault.
10.3 The Website may be temporarily unavailable for maintenance or for reasons beyond the Seller's control. The Seller does not guarantee uninterrupted access.
11 - Intellectual property
All content on the Website (designs, photographs, texts, logos, brand name, product creations) is the property of the Seller and protected by intellectual property law. Any reproduction, representation or reuse, in whole or in part, without the Seller's prior written permission is prohibited. Buying a product does not transfer any intellectual property rights. The Customer may not reproduce or sell copies of the designs.
12 - Personal data
The Seller collects and processes personal data necessary to handle orders, deliver products, manage the customer relationship and meet legal obligations. Processing is carried out in accordance with the GDPR and the French Data Protection Act. Customers have rights of access, rectification, erasure, restriction, objection and portability, which they may exercise by writing to alice.watel@gmail.com. They may also lodge a complaint with the CNIL (www.cnil.fr).
13 - Proof
Data recorded by the Seller constitutes proof of all transactions concluded between the Seller and the Customer. Data recorded by the payment system constitutes proof of financial transactions. It is expressly agreed between the Seller and the Customer that emails shall serve as evidence between the parties, as shall the automatic recording systems used on the Website, particularly regarding the nature and date of the order.
